The Illinois autism insurance mandate
Illinois Public Law 095-1005 was enacted in 2008 and took effect on December 12, 2008. It requires state-regulated plans to cover the diagnosis and treatment of autism spectrum disorders, including ABA, for individuals under age 21, with a maximum annual benefit of $36,000 (Autism Speaks).
The 2022 amendment matters for in-home families
A 2022 amendment clarified that insurers may not deny covered services based on where those services are provided, and home-based services are explicitly included. For a family choosing in-home ABA, that is the sentence that settles the question: the setting is not a reason for a state-regulated plan to refuse a covered service.
The caveat we will not bury
The mandate applies to state-regulated plans. It does not apply to self-funded ERISA plans, which many large employers use, and those plans set their own terms. Many of them do cover ABA — it simply is not the state law that requires it. Benefits vary by plan either way, and the only way to know your family's actual coverage is to check your specific plan.
