Where services are provided is not a reason to deny them
The part of the Illinois law that matters most to the families we serve is the clause about setting. A 2022 amendment clarified that insurers may not deny covered services because of where those services are provided, naming home-based and school-based services alongside clinic-based services (Autism Speaks). Because we are an in-home-only practice, that clause is the legal footing under everything we do. A covered service does not become uncovered simply because it happens at your kitchen table.
The underlying law, Public Law 095-1005, was enacted in 2008 and took effect December 12, 2008. It requires state-regulated plans to cover the diagnosis and treatment of autism spectrum disorders, including habilitative and rehabilitative care such as Applied Behavior Analysis, for individuals under age 21, with a maximum annual benefit of $36,000. It reaches state employee health plans, individual plans, and fully insured large and small group plans.
UnitedHealthcare also administers many self-funded employer plans, which are governed by federal ERISA rules rather than the Illinois mandate. Those plans frequently cover ABA, but not because state law compels them to, so we read the plan itself rather than assuming.
How authorization works with UnitedHealthcare
Your BCBA completes the in-home assessment and writes a treatment plan with individualized goals and a recommended service level. We submit that plan to UnitedHealthcare, follow the review, supply any additional clinical documentation the plan requests, and tell you as soon as we hear back. Ongoing care is re-authorized periodically as goals are updated, and our team manages each renewal so services continue without a gap you have to chase.
