The Illinois mandate and habilitative care
The wording that matters most for Blue Cross Blue Shield families is habilitative care. Illinois' autism insurance law, Public Law 095-1005, requires state-regulated plans to cover the diagnosis and treatment of autism spectrum disorders including habilitative and rehabilitative care such as Applied Behavior Analysis, alongside behavioral, speech, occupational, and physical therapy (Autism Speaks). Habilitative care means teaching a skill a child has not yet developed, rather than restoring one that was lost. That distinction used to be a common reason for denial. Under the Illinois law it is explicitly covered.
The law took effect December 12, 2008, applies to individuals under age 21, carries a maximum annual benefit of $36,000, and reaches state employee health plans, individual plans, and fully insured large and small group plans. A 2022 amendment added that insurers may not deny covered services based on where those services are provided, with home-based services explicitly named.
Blue Cross Blue Shield also administers self-funded (ERISA) employer plans, which are governed by federal law rather than the Illinois mandate. Many of those plans cover ABA voluntarily, but the state requirement does not automatically apply to them.
